1. Who we are
This e-commerce website skyou-bike.com ("Site") is operated by Skyou Srl, registered office at Piazza Nilde Iotti 13/10, 56025 Pontedera (PI), Italy — VAT/Tax ID 02585990506 ("SKYOU", "we"). Email: info@skyou-bike.com.
2. Purpose
These Terms and Conditions of Sale ("Terms") govern the purchase of products (e-bikes, accessories, spare parts) through the Site. By placing an order, the Customer fully accepts these Terms, the Privacy Policy and the Cookie Policy.
3. Who may purchase
Purchases are reserved for adults with full legal capacity. SKYOU reserves the right to refuse or cancel orders in case of suspected fraud, an obvious price/description error, or breach of these Terms.
4. Products, prices and availability
Products are described as accurately as possible; colours and details in photos may slightly differ from the actual product.
Prices are in Euro (€), VAT included unless otherwise stated.
SKYOU may change prices at any time; the price applied is the one shown when the order is confirmed.
If a product becomes unavailable after ordering, the Customer will be informed and any amount paid will be refunded.
5. Payment methods
Payments are processed via Shopify Payments (credit/debit cards) and PayPal. Payment data is handled directly by these providers under their own terms and privacy notices; SKYOU does not store full card data.
6. Order confirmation
The Customer receives a confirmation email once the order is placed. The contract is concluded when SKYOU confirms acceptance of the order.
7. Delivery
Delivery methods, timing and costs are governed by our Shipping Policy, an integral part of these Terms.
8. Right of withdrawal and returns
Customers purchasing as consumers within the EU have the right to withdraw within 14 days of delivery, without giving any reason, as detailed in our Refund Policy, an integral part of these Terms.
9. Legal warranty of conformity
EU consumers benefit from a 24-month legal warranty of conformity from delivery. In case of a defect, the customer is entitled to repair, replacement, price reduction or termination of the contract, as applicable. To activate it: info@skyou-bike.com, with proof of purchase and a description of the defect. The warranty does not cover damage from misuse, accidents, normal wear of consumable parts (tyres, brake pads, chain), or assembly/maintenance not carried out according to the instructions provided.
10. Product use and safety
SKYOU e-bikes must be assembled, used and maintained according to the instructions provided. The Customer is responsible for complying with traffic laws and local regulations applicable to e-bikes in their country of residence (power/speed limits, insurance, helmet requirements, etc., where applicable).
11. Intellectual property
All Site content (text, images, logos, the SKYOU trademark) is owned by or licensed to Skyou Srl and protected by intellectual property law. Reproduction without written authorisation is prohibited.
12. Limitation of liability
To the extent permitted by law, SKYOU is not liable for indirect damages arising from use of the Site or products, except in cases of wilful misconduct or gross negligence, without prejudice to consumers' mandatory rights.
13. Governing law and jurisdiction
These Terms are governed by Italian law. For consumers, the mandatory jurisdiction of the consumer's place of residence applies, where located in Italy. For non-consumer customers, the Court of Pisa has exclusive jurisdiction. EU consumers may also use the European Commission's ODR platform: https://ec.europa.eu/consumers/odr
14. Changes to these Terms
SKYOU may amend these Terms at any time; changes apply to orders placed after publication.
